PLEASE READ THE TERMS AND CONDITIONS BELOW CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. THEY INCLUDE VARIOUS LIMITATIONS AND EXCLUSIONS, AND A DISPUTE RESOLUTION CLAUSE THAT GOVERNS HOW DISPUTES WILL BE RESOLVED.

1. AGREEMENT.

1.1 Terms. Your use of the Game is governed by, and conditioned on, your acceptance of these terms and conditions and the privacy and support policies(collectively, these terms and conditions and such other policies are referred to as the “Agreement”). By using the Game, you agree to be bound by the Agreement.

1.2 Changes. AfreecaTV may modify this Agreement from time to time and such modification shall be effective once posted. You agree to be bound to any changes to this Agreement when you use the Game after any modification to this Agreement has been posted.

2. USE OF THE GAME.

2.1 General. The Game is an online casual racing game service with certain optional fee-based elements and features (“Additional Features”) accessible either within the Game or online through the Game web site, currently at http://kb.afreeca.tv(the “Site”). To use the Game, you will need to install software which AfreecaTV makes available from the Site via download or official torrent tracker, or which you have acquired from a retailer or third party site. (the “Software”). While you may use the Game on a limited trial or demonstration basis without registering for an account, your use of the Game is, nonetheless, subject to this Agreement, and you must establish an account using the registration system provided for full use of the Game (an “Account”). The Site is an active part of the Game and any use of the website is governed by the same terms and conditions of this Agreement.

2.2 Accounts. For each Account, you will be required to provide us with a valid e-mail address and indicate your acceptance of all of the terms and conditions of this Agreement and our Privacy Policy. If you do not provide us with a valid e-mail address and/or do not agree to all of the terms and conditions of this Agreement and the Privacy Policy, you will not be able to sign up for an Account and you shall not have the right to use the Service, which includes the right use the Site's social networking features or the right to play the game. You are solely responsible for all activities conducted through your Account. You acknowledge and agree that you do not own the Account - you merely use the characters created on the Account, the items stored on Game servers, or any other data from which the servers and accounts are comprised.

2.3 Passwords. You are responsible for maintaining the confidentiality of your Account password. At no time should you respond to an online request for a password. AfreecaTV will never ask for your password offline or online, except that you will be required to enter your password as part of the log-on process.

2.4 Information; Former Users. You agree to provide true, accurate, current and complete information about yourself upon registration and maintain and promptly update such information. If you provide any information that is, or reasonably appears to be, untrue, inaccurate, not current or incomplete, AfreecaTV has the right to suspend or terminate your Account and refuse any and all current or future use of the Game. Users whose Accounts have been terminated by AfreecaTV may not access the Game in any manner or for any reason, including through any other Account, without the express written permission of AfreecaTV. Accounts accessed by former users are subject to immediate termination. AfreecaTV reserves the right to use any means necessary to identify and remove former users. If AfreecaTV terminates an Account, AfreecaTV may terminate any other Accounts that share the same member name, phone number, email address, postal address, Internet Protocol address, or credit card number with the terminated Account.

2.5 Messaging. In the Game, characters may send server wide messages. Due to the fact that this communication channel has the ability to impact every player on the server, AfreecaTV will not tolerate any inappropriate behavior in this chat channel. This includes inappropriate language of any sort or any attempt to escape the profanity filter, inappropriate or vulgar content of any sort, repeated “spamming,” or “flooding” of the chat messages channel, or any other conduct determined to be inappropriate by AfreecaTV support, in its sole discretion. Any violation of this term or rules of conduct may, in the sole discretion of AfreecaTV, lead to the temporary removal of the character’s ability to communicate, the account being suspended for a set period of time, or lead to permanent account closure.

2.6 Support; Site Maintenance. In-game support may be available through “Game Masters” and otherwise in FAQ or other support sections of the Site. While AfreecaTV will use its best efforts to maintain the Game so as to minimize downtime and provide as much communication as possible regarding downtime, feature updates and other news, User acknowledges that the Game and Site may be unavailable for scheduled and emergency maintenance. AfreecaTV will make regular backups with regard to the Game to safeguard the Game world state, provided, however, that there may be instances where the world state may need to be reset to its default state.

4.4 Pricing. AfreecaTV reserves the right to alter the fees payable for new Additional Features or introduce alternative fee structures for the Game. Any alterations will be posted on the Site at least 14 days prior to taking effect.
